Privacy Policy

My True, Inc., a Delaware corporation (“we,” “us,” or “our”), operator of Evolve’s mobile applications and web site (together, the “App”), knows that you care about how information about you is used and shared. This Privacy Policy explains what information of yours will be collected by us when you use the App and how the information will be used. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources. Capitalized terms that are not defined in this Privacy Policy have the meaning given them in our Terms of Service. This Privacy Policy constitutes an integral part of our App’s Terms of Service and is subject to the provisions thereof, including with respect to Limitation of Liability and governing law. We encourage you to read this Privacy Policy before you use the App or send or share information with us, and to read it again when we notify you of changes to the Privacy Policy that are made from time to time.


What Information We Collect

We collect and store the personal information you enter on the App or otherwise provide to us. This includes identifying information such as your name, address, email address and telephone number, and, if you transact business with us, financial information such as your payment method (credit card number, expiration date, etc.). You may also provide us information about your interests and activities, your gender and age, and other demographic information such as your education or your username. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We may also retain any messages you send through the App. You may provide us information in any content you post to or on the App.


We may also obtain personal and non-personal information about you from business partners and other third parties and add it to our account information or other information we have collected. We may also receive information about you from third party social platforms, such as Facebook. When you access or use the App through such a site you allow us to access or collect information made available by the third party site in accordance with its privacy policies. This information may be available from your profile or account with such site or from cookies placed on your device by the third party platform. In addition, we may collect and store personal information about other people that you provide to us, such as their name, age, and telephone number.  


When you use the App, we may send one or more cookies to your computer or other device that uniquely identifies your browser or device and lets us help you log in faster and enhance your navigation through the App. Through this process, we automatically collect information from your browser or device when you visit the App, including your IP address, device ID, your browser type and language, access times, the content of any undeleted cookies that your browser or device previously accepted from us, and any referring website address.    

When you use the App, we may employ clear gifs (also known as web beacons) which are used to track the online usage patterns of our users anonymously. In addition, we may also use clear gifs in HTML-based emails sent to our users to track which emails are opened by recipients. The information is used to enable more accurate reporting, improve the effectiveness of our marketing, and make the App better for our users.

We may use third party analytics services to help understand the use of the App and improve its functionality. These services collect the information sent by your browser or device, including cookies and your IP address, and their use of such information is governed by their respective privacy policies.


How We Use Your Information

We use the personal information you submit to operate, maintain, and provide to you the features and functionality of the App. In addition, we use the information that we collect to: (i) deliver our products and services, and manage our business; (ii) manage your account and provide you with customer support; (iii) perform research and analysis about your use of, or interest in, our products, services, or content, or products, services or content offered by others; (iv) communicate with you about products or services that may be of interest to you from us and third parties; (v) develop and display content and advertising tailored to your interests on our site and other sites, including providing our advertisements to you when you visit other sites; (vi) perform ad tracking and website or mobile application analytics; (vii) verify your eligibility and deliver prizes in connection with contests and sweepstakes; (viii) enforce or exercise any rights in our terms and conditions; (ix) perform functions as otherwise described to you at the time of collection; and (x) register you with and display your profile on the App.


We may also use financial information or payment method information to (i) process payment for any purchases made on the App, (ii) enroll you in the discount, rebate, and other programs in which you elect to participate, (iii) protect against or identify possible fraudulent transactions, and (iv) otherwise as needed to manage our business.

In all circumstances, we may perform these functions directly or use a third party vendor to perform these functions on our behalf who will be obligated to use your personal information only to perform services for us. Also, if you access the App from a third party social platform, such as Facebook, we may share non-personal information with that platform to the extent permitted by your agreement with it and its privacy settings.


By providing your email address to us (including by “following,” “liking,” linking your account to the App, etc., on a third party website or network), you consent to our using the email address to send you App-related notices, including any notices required by law, in lieu of communication by postal mail. You also agree that we may send you notifications of activity on the App to the email address you give us, in accordance with any applicable privacy settings. We may use your email address to send you other messages, such as newsletters, changes to features of the App, or special offers.

If you do not want to receive such email messages, you may opt out or change your preferences on the App or by emailing us at info@evolveapp.com. Opting out may prevent you from receiving email messages regarding updates, improvements, or offers. You may not opt out of App-related emails.


Following termination or deactivation of your user account, we may retain your profile information and any content submitted by you (“User Content”) for a commercially reasonable time for backup, archival, or audit purposes. Furthermore, we may retain and continue to use indefinitely all information (including User Content) contained in your communications to other users or posted to the App after termination or deactivation of your account.

We may use certain information about you and/or your User Content internally for purposes such as analyzing how the App is used, diagnosing service or technical problems, maintaining security, and personalizing content. We reserve the right, but have no obligation, to monitor the information and materials you post on the App.

We use cookies, clear gifs, and log file information to: (i) remember information so that you will not have to re-enter it the next to you access the App; (ii) provide customized and personalized content and information; (iii) monitor the effectiveness of our App; (iv) monitor aggregate metrics such as total number of visitors, traffic, and demographic patterns; (v) diagnose or fix technology problems reported by our users or engineers that are associated with certain IP addresses; (vi) help you efficiently access your information after you sign in; and (vii) track User Content and users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act.


How We Share Your Information

Except as otherwise set forth herein, we will not rent or sell your personally identifiable information to others. We may share your personally identifiable information with third parties for the purpose of providing the App to you. If we do this, such third parties’ use of your information will be bound by this Privacy Policy. Notwithstanding the foregoing, we may transfer, sell and/or assign your information (including personal information and User Content) to third parties in connection with a sale of My True, Inc. or the App, whether by way of a sale of stock, sale of assets, merger, divestiture, bankruptcy, dissolution or otherwise.


We also may disclose your information, including personal information: (i) in response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; (ii) to enforce our Terms and Conditions or other policies; (iii) to take precautions against liability; (iv) to investigate and defend ourselves against any third-party claims or allegations; (v) to protect the security or integrity of the App; (vi) to protect and defend the rights, property or safety of our company, our users, our employees, or others; (vii) when we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; or (viii) to comply with applicable law. In such cases, we may raise or waive any legal objection or right available to us.  


Any personal information or content that you voluntarily disclose for posting on the App may become available to the public in an aggregated or other fashion that does not reveal your identity. We may store personal information in locations outside the direct our control (for instance, on servers or databases located with hosting providers). We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks) with interested third parties to help them understand the usage patterns of the App.

We may allow third-party ad servers or ad networks to serve advertisements on the App. These third-party ad servers or ad networks use technology to send advertisements and links that appear on the App. They automatically receive your IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or web beacons) to measure the effectiveness of their advertisements and to personalize the advertising content. We do not provide any personally identifiable information to these third-party ad servers or ad networks without your consent. However, if an advertiser asks us to show an advertisement to a certain audience and you respond to that advertisement, the advertiser or ad server may conclude that you fit the description of the audience they are trying to reach. Our Privacy Policy does not apply to, and we cannot control the activities of, third-party advertisers. Please consult the respective privacy policies of such advertisers for more information.


How We Protect Your Information

We care about the integrity and security of your personal information and we take reasonable and appropriate security measures to help safeguard your personal information from unauthorized access and disclosure. We want you to feel confident using the App, however, no system can be completely secure and we cannot ensure or warrant the security of any information you transmit to us or guarantee that your information on the App may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Your privacy settings may also be affected by changes to the functionality of our distributors, such as social networks. We are not responsible for the functionality or security measures of any third party. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from us, at all times. Please refer to the Federal Trade Commission’s website for information about how to protect yourself against identity theft.


What We Do If Your Personal Information Is Compromised

In the event that personal information is compromised as a result of a breach of security, we will notify those persons whose personal information has been compromised in accordance with the notification procedures set forth herein or as otherwise required by applicable law.


Your Choices About Your Information

You may decline to submit personally identifiable information through the App, in which case we will not be able to provide certain services to you and you may not be able to register as a member, purchase products or services, ask a question, or initiate other transactions on the App. You may update or correct your account information and email preferences at any time by logging in to your account. When a request for user deletion is received, we will make all reasonable efforts to purge your information from our systems. However, due to the nature of our service, some information may not be fully removed due to backups or archived copies. Our applications may also deliver notifications to your phone or mobile device. You can disable these notifications in your device’s settings in your account under “Settings” or by deleting the relevant application.


Rights Of Third Parties

This Privacy Policy does not create rights enforceable by third parties or require disclosure of any personal information relating to users of the App.


Children’s Privacy

Although the App is generally available for download, we endeavor to restrict the use of the App to individuals age 18 and above. We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register for a user account. No one under the age of 13 is allowed to provide any personal information to us or on the App. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Non-U.S. Residents

If you do not reside in the U.S. and are using the App, if you provide personal information to us it may be transferred to and processed on computers in the U.S. and other countries. Do not provide your personal information to us if you do not want this information to be transferred outside of your country, or if the laws in your country restrict these types of transfers. Your provision of personal information to us will be handled in accordance with this Privacy Policy. From time to time, your personal information may be transferred to a country different from where you are located, and processed there in accordance with this Privacy Policy. You hereby consent to such transfers and processing as described in this Privacy Policy. Your provision of personal information to us through the App means that you agree to the terms hereof.


Links To Other Web Sites

We are not responsible for the practices employed by websites linked to or from the App, nor the information or content contained therein. Please remember that when you use a link to go from the App to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our App, is subject to that website’s own rules and policies. Please read over those rules and policies before proceeding.


Notification Procedures

It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on the App, as we determine in our discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.


California Online Privacy Protection Act Notice

On September 27, 2013, California enacted A.B. 370, amending the California Online Privacy Protection Act to require website and mobile application operators like us to disclose how we respond to “Do Not Track Signals”; and whether third parties collect personally identifiable information about users when they visit us. (1) We do not track users who do not interact with its sharing functionality across the web, and therefore do not use “do not track” signals. (2) We do not authorize the collection of personally identifiable information from our users for third party use through advertising technologies without separate member consent.


California Privacy Rights

California Civil Code Section 1798.83 also permits our users who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to info@evolveapp.com. Please note that we are only required to respond to one request per customer each year.


Changes To This Privacy Policy

We may update this Privacy Policy from time to time, and so you should review this Privacy Policy periodically. When we change the Privacy Policy in a material way, we will update the ‘last modified’ date at the bottom of this Privacy Policy. Acceptance Of These Terms

By using this App, or providing information to us, you signify your agreement to this Privacy Policy.
